• Ford Motor Company: In a groundbreaking class-action trial against Ford, the court ordered the first-ever judicially mandated automotive recall in U.S. history. The court found Ford had concealed a dangerous defect affecting millions of vehicles nationwide—a defect that could have been remedied for approximately $4 per vehicle. After extensive litigation, the case resulted in a nationwide settlement valued at $2.7 billion.

• Apple Inc.: FM negotiated a $53 million cash settlement providing affected consumers with an average recovery of 117% of their actual losses—an exceptional result demonstrating FM's commitment to maximizing client recovery.

• Toyota Motor Corporation: Serving as co-lead counsel alongside Miller Barondess LLP, FM successfully litigated a class action prompting Toyota to recall over 1.1 million Prius vehicles due to defective Intelligent Power Modules (IPMs). The resulting settlement—valued at approximately $200 million—included a $20 million cash fund for class members, a 20-year warranty extension without mileage limitations, and additional consumer protections such as free towing and rental cars.

• Volvo Cars of North America: In litigation involving Volvo's secret warranties covering defective Electronic Control Modules (ETMs), FM secured relief for approximately 250,000 vehicle owners nationwide—ensuring reimbursement or replacement of ETMs costing roughly $1,000 each.

• Airborne Health Supplements: Partnering with the Center for Science in the Public Interest as co-lead counsel, FM achieved a $23 million settlement against Airborne Health for false advertising practices. This high-profile case was featured by Time magazine and satirized on The Colbert Report.

• Pegasus Wireless: After the Pegasus board of directors approved the sale of $10 million of stock in Pegasus Wireless Corporation to Pegasus's CEO and the subsequent repurchase of stock for the original sale price after stock price plummeted from $8 to less than $1 a share, FM brought a shareholder-derivative action. The case was one of many derivative suits and class actions alleging director misconduct, but it was the only one to survive two bankruptcy petitions and multiple dispositive motions that resulted in the dismissal of other actions. After Pegasus's former Pegasus CEO and CFO were found liable for stock fraud in an SEC action (and sentenced to 21 and 9 years in prison, respectively), FM successfully negotiated a settlement of all claims with remaining defendants.

FM's dedication extends beyond traditional litigation. We have represented leading consumer advocacy organizations—including Public Citizen, the Center for Auto Safety, Friends of the Earth, and the Center for Science in the Public Interest—in significant trial and appellate matters, and have worked with them as co-counsel in other matters.

In a notable case we prosecuted with the Animal Legal Defense Fund (ALDF), FM challenged deceptive marketing practices by an egg producer that falsely claimed humane conditions for hens. Our successful resolution required substantial improvements aligning actual conditions with advertised standards. ALDF honored FM with its Advancement in Animal Law Pro Bono Achievement Award for this impactful work.
