Windshields That Crack -- Even While Parked in a Garage
Fazio | Micheletti LLP is prosecuting a class action on behalf of owners of 2005 and later model-year Honda Element sport utility vehicles wtih defectively-designed and manufactured windshields that have a propensity to crack upon the slightest impact -- or no impact at all while parked. Because the windshield glass is an integral part of the roof structure, a crack can severely weaken the ability of the vehicle’s roof to withstand crushing in the event of a roll-over. And the problem is, of course, even more disconcerting in a sport utility vehicle, which are known to be more prone to rolling over than other vehicles.
Fazio | Micheletti served as lead counsel in another class action against Honda that involved this problem, and that case settled approximately two years ago after Honda agreed to reimburse the cost of repairing and repairing the windshields. That case was limited to 2003 and 2004 model-year Elements, however, and Honda has declined to repair or replace windshields that have cracked in Elements that were sold in and after the 2005 model year.
